Dear Suppliers,

Honey and food supplements containing pollens from GMOs are foodstuffs produced from GMOs, which are
not authorized for sale in the market without previous permission.

-The European Court came to this conclusion in its judgment on Case C-422-09 on 06.09.2011, stating as follows:

-> Honey containing pollens of a genetically modified plant is, according to the Directive (EG) Nr.1829/2003, to be
regarded as a foodstuff containing ingredients produced out of GMOs

-> The contained GMO-pollens must be authorized prior to their introduction in the market

- We understand this judgment as follows:

-> Pollens in honey are regarded as an ingredient

-> Pollens from genetically modified plants require an authorization. This authorization does not depend on the
proportion of the genetically modified substance

-> Honeys, containing substances from genetically modified plants that are comprehensively permitted as foodstuffs,
are authorized for sale in the market

-> For genetically modified plants that are not comprehensively permitted as foodstuffs, the tolerance threshold is zero.

- That means the following:

-> Pending and future contracts with you as well as lots of honey from you which we have still on stock have to be free of GMO pollen.

-> For new shipments you need to send us a CoA (Certificate of Analysis) which confirms that the honey is free of GMO.

To whom it may concern

With reference to yesterday's expected decision of the European Court of Justice regarding GMO and Honey, we ask you to present your position. Furthermore, we ask you to confirm and provide proof of the following:

a) That the honey delivered to us by your company as per our product specifications does not exceed the limit of 0,9% pollen from genetically modified plants specified in the EU Gene Ordinance 1829/2003. Please provide verification in the form of analysis reports from an independent Laboratory.

b) Please indicate to us what measures you undertake / have undertaken to ensure as of this date the delivery of goods acceptable according to food law in the sense of the court decision mentioned above

c) That the origin of the honey delivered to us by your company is guaranteed to be outside of a 10 kilometer radius away (the distance which is recognized by scientific experts to be the area of risk) from the nearest cultivation of GMO crops.

Referente a la decisión del Corte Europeo de Justicia de ayer con respecto a OGM y a la miel de abeja les pedimos explicarnos la posición de su casa y de confirmarnos y nos dar pruebas de los puntos siguientes:

a) Que la miel suministrada a nosotros de su casa segun nuestras especificaciones no exceda el límite de 0,9% de polen de plantas OGM determinado en el EU Reglamento sobre OGM no. 1829/2003. Favor de enviarnos certificados de análisis recientes de laboratorios independientes.

b) Favor de explicarnos las medidas utilizadas por Vds. para garantizar el suministro de una mercancía segura segun la legislación alimentaria con respecto a la decisión arriba mencionado

c) Que la miel suministrada por su casa tiene su origen garantizadamente fuera de un radio de min. 10 kilometros (la distancia de riesgo reconocido por los expertos científicos) de una cultivación de plantas OGM
